The Good Law Project has stated that it will challenge the EHRC’s guidance in November

The Equality and Human Rights Commission (EHRC) is planning not to read 50% of consultation responses to the UK Supreme Court ruling, The Good Law Project reported. 

In April, the UK Supreme Court ruled that the definition of “woman” in the Equality Act 2010 would refer to “biological sex”. Following this, the EHRC launched their consultation on proposed changes to its code of practice on services, public functions and associations. This consultation offered the chance for trans voices to finally be heard. 

The Good Law Project revealed that in six weeks, over 50,000 people sent in their submissions to this consultation. Using leaked documents, the Good Law Project wrote that the EHRC will not read half of these consultation responses and wrote that “AI will determine whether people’s stories will be heard”. 

Jude Guaitamacchi, founder of Trans+ Solidarity Alliance, commented on this news: “The EHRC have treated this entire process like a game from the start, with the objective of removing fundamental rights from trans people in this country. This flies in the face of all normal practice when dealing with consultations, and leaves the commission’s credibility in ruins.”

At the end of April, the EHRC released their interim guidance on how organisations should interpret the UK Supreme Court Ruling. In this guidance, the EHRC stated that “trans women should not be permitted to use the women’s facilities”.

Jude continued: “If implemented as currently drafted, its proposed Code of Practice would turn the Equality Act into a bathroom ban – mandating the exclusion of trans people across public life. The EHRC has shown it cannot be trusted with our human rights, and it is time for urgent action to stop it from destroying them.”

The Good Law Project has announced that it will be challenging the EHRC over its guidance in November.
